Loan Recovery Strategies for Microfinance Banks in Nigeria
Reviewed by Adebayo Sobayo and Adedeji Adeyemo, Legal Practitioners
The most effective loan recovery strategy for a microfinance bank is early, structured and lawful: contact borrowers at the first missed payment, offer a realistic repayment plan in writing, bring in guarantors early, send a lawyer’s letter of demand when engagement fails, and take small balances to the Small Claims Court rather than writing them off. Every step should follow the CBN Consumer Protection Regulations.
1. Act at the first missed payment
The earlier you engage, the more you recover. The CBN rules require you to monitor loan performance and engage the customer about alternative repayment options as soon as repayment difficulties appear (section 5.2.5), and to send the default notice on the first day of default (section 4.6). Treat the first week after a missed payment as the most important.
2. Sort your overdue book
Group accounts by how long they have been overdue, the balance, and the strength of the file (signed agreement, statement, guarantor, address). This tells you where to spend your team’s time: early arrears need calls and plans, older arrears with strong files need formal demands, and weak files need their documents fixed first.
3. Restructure where the borrower can pay something
A borrower who can pay part is worth more than one pushed into silence. Agree a new schedule in writing and have the borrower sign it: it is an acknowledgement of the debt you can rely on later. Remember that a request for a concession must be answered within 10 working days, or it is treated as granted (section 3.2.7).
4. Engage guarantors early
You must give guarantors periodic updates on the loan’s performance (section 5.2.8), so a guarantor should never be surprised. A guarantor can be asked to pay under the terms of their guarantee, which is easier to enforce if they confirmed it in writing when the loan was granted (section 5.2.7).
5. Send a letter of demand when engagement fails
When calls and plans have not worked, a formal letter of demand, signed by a lawyer, states the balance and a deadline and shows the borrower that court is the next step. In Lagos it is also a condition for using the Small Claims Court (Lagos Practice Direction on Small Claims 2023, Article 2).
6. Take small balances to the Small Claims Court
Many microfinance loans are well under ₦5,000,000, the Lagos Small Claims Court limit (excluding interest and costs). The procedure is simplified, a company can be represented by its own principal officer, and the target is 60 days from filing to judgment (Lagos Practice Direction on Small Claims 2023, Articles 2, 11 and 13). That makes court worthwhile for balances that a traditional lawsuit would never justify. See the Lagos Small Claims Court rules.
7. Keep every contact lawful
- Contact the borrower or a guarantor only, and never ask friends, family, neighbours or the employer to pay (section 5.5.7).
- No calls or visits between 9.00pm and 8.00am without prior consent (section 5.5.7).
- No threats, abusive language or humiliation (sections 3.2.1 and 5.5).
- If you use recovery agents, you are liable for what they do (section 5.5.6), so give them written rules and check their work.
Breaking these rules invites complaints, sanctions and a weaker case in court. Read the CBN rules on debt recovery in full.
8. Measure and report every week
Track, for each account: the last contact, the borrower’s response, the amount promised and paid, and the next step. A weekly view of sent, responded, paid, disputed and needs-escalation tells management which strategy is working.
Pandas LP handles steps 5 and 6 for microfinance banks at a fixed fee per account: a demand letter reviewed and signed by a licensed practitioner from ₦20,000, reminders on days 7, 10 and 14, a weekly report on every file, and the Small Claims forms if the borrower still does not pay. Start with a pilot of 10 to 20 files. Loan recovery for lenders.

Common questions
What is the best loan recovery strategy for a microfinance bank?
Early contact at the first missed payment, written repayment plans, early guarantor engagement, a lawyer’s letter of demand when engagement fails, and the Small Claims Court for smaller balances, all within the CBN Consumer Protection Regulations.
Can a microfinance bank use the Small Claims Court?
Yes. In Lagos, a claim of up to ₦5,000,000, excluding interest and costs, can be brought once a letter of demand has been served, and a company can be represented by its own principal officer (Lagos Practice Direction on Small Claims 2023, Articles 2 and 11).
Can we ask a borrower’s family to pay?
No, unless the family member is a guarantor. CBN-regulated lenders may contact friends, relatives, neighbours or employers only for the borrower’s employment status, phone number or address, unless the person consented (section 5.5.7).
